Flower Moxie Terms & Conditions

These Terms & Conditions (“Terms”) govern your use of flowermoxie.com (the “Site”) and any purchase of products or services from Flower Moxie, LLC (“Flower Moxie,” “we,” “us,” “our”). By accessing the Site, creating an account (if applicable), or placing an order, you agree to these Terms and our Privacy Policy.
If you do not agree, please do not use the Site or purchase from Flower Moxie.
1) What We Sell
Flower Moxie sells fresh flowers (perishable, time-sensitive) and supplies/hard goods (non-perishable). We also provide educational content such as guides, recipes, videos, and instructions (collectively, “Content”).
Some policies apply to all orders; some apply only to fresh flowers or only to supplies. Where there’s a conflict, the more specific section controls.
2) Eligibility
You must be the age of majority in your state or province to place an order. Purchases are for personal use only unless we approve resale in writing.
3) Orders, Pricing & Payment
- Order acceptance: Your order is not guaranteed until we accept and process it. We may refuse or cancel orders at our discretion (including fraud concerns, availability, or errors).
- Pricing & errors: Prices, product descriptions, and availability may change at any time. If an error occurs (pricing, description, inventory), we may correct it and/or cancel the order and refund amounts paid for unfulfilled items.
- Payment: By placing an order, you authorize us and our payment processors to charge your payment method for the full amount shown at checkout, including shipping and taxes.
4) Shipping & Delivery (All Orders)
Delivery Dates Are Estimates
We ship using third-party carriers (such as FedEx, UPS, USPS, and/or regional carriers). Delivery dates and transit times are estimates and are not guaranteed by time of day.
You Are Responsible for Receiving Delivery
You are responsible for ensuring someone can receive the delivery and bring it inside promptly. Carriers may leave packages without a signature (or may require one), at the driver’s discretion and based on local protocols.
Flower Moxie is not responsible for:
- packages left unattended,
- theft after delivery,
- heat/cold exposure after delivery,
- delays due to weather, natural disasters, carrier disruptions, or mechanical failures.
Missed Deliveries / Carrier Holds
If the carrier attempts delivery and you are unavailable, and the package is held/delayed/returned, you are responsible for coordinating pickup or redelivery directly with the carrier. Due to carrier rules, we are generally unable to coordinate redelivery on your behalf.
For fresh flowers, missed deliveries and carrier holds can materially impact quality and may void eligibility for refunds or replacements.
5) Fresh Flowers: You’re the Florist
By purchasing fresh flowers from Flower Moxie, you acknowledge you are taking on the role of florist.
You are responsible for:
- reading and following all care instructions,
- properly processing and hydrating flowers immediately upon arrival,
- storing flowers appropriately (temperature, water, timing),
- planning adequate time for hydration and bloom opening.
We provide detailed instructions on product pages and through our Flower Care resources, but results depend on handling, environment, and timing.
6) Fresh Flowers: Natural Product Expectations (Loss, Variation, Imperfections)
Flowers are a natural agricultural product. You understand and accept that:
- a small percentage of loss is normal (typically 5–10%),
- some blooms may arrive tighter and require hydration time to open,
- minor blemishes, spotting, petal bruising, color variance, size variance, and stem variance can occur naturally,
- some stems may be removed during prep as part of normal design and processing.
Flower Moxie guarantees the overall quality and freshness of the shipment, not that every stem will be perfect.
7) Fresh Flowers: Substitutions
Flower Moxie may make substitutions only when reasonably necessary due to availability or quality concerns.
- Substitutions will be comparable in style and value.
- We will not substitute premium flowers with significantly lower-value alternatives.
- Substitutions are not eligible for refund.
8) Accurate Event Information (Fresh Flowers)
You are responsible for providing accurate event details, including the true event date.
Flower Moxie accommodates Friday–Sunday weddings only.
Customers sometimes enter an inaccurate event date to receive flowers earlier or later than recommended. If you provide inaccurate information, you may become ineligible for replacements or refunds because it prevents us from supporting the order appropriately.
9) Fresh Flowers: Claims, Refunds & Replacements
Because flowers are perishable, strict claim requirements apply.
Claim Window
You must contact Flower Moxie within 24 hours of delivery or pickup if there is an issue such as:
- significant damage affecting the order beyond normal loss,
- missing bunches/items,
- major quality issues impacting the shipment as a whole.
Photos Required
Claims must include clear photos showing:
- the box and shipping label,
- the full contents of the shipment,
- the affected flowers/items clearly visible.
We cannot evaluate claims without photos.
Do Not Discard Flowers
Do not throw away flowers or packaging until Flower Moxie reviews the claim and confirms what we need.
What We Do / Don’t Cover
- We do not reimburse flowers purchased elsewhere without prior written approval.
- We do not issue refunds for slight color variation or natural variation.
- Claims submitted after the event, after 24 hours, or without photos will be refused.

10) Fresh Flowers: Cancellations
Fresh flower orders may be canceled 30 days prior to the scheduled delivery date for a refund.
No refunds are provided for cancellations inside 30 days of the scheduled delivery date because flowers have been secured. No exceptions.
Excessive order changes may incur an additional fee at our discretion.
11) Fresh Flowers: Order Changes / Add-Ons
You may request additions/changes by emailing orders@flowermoxie.com with your order number and requested items.
- If changes are made at least 30 days before your delivery date, we generally can combine shipments so you don’t pay shipping twice (when operationally feasible).
- Requests within 14 days of delivery carry an expedited fee of $50 (and may not be possible).
- We strive to be customer-first, but changes are not guaranteed.
12) Supplies (Hard Goods): Shipping, Claims & Returns
Supplies Shipping
Supplies ship via carriers such as FedEx or USPS. Typical delivery is 4–14 days, depending on location and carrier conditions. Delivery timing is not guaranteed.
Supplies Claims (Damaged/Missing)
If your supplies arrive damaged or missing, you must notify us within 24 hours of delivery with photos.
Flower Moxie will not reimburse supplies purchased elsewhere. We will refund or replace only our supplies, subject to timely notice and photo documentation.

Supplies Returns (30 Days)
Any supply product may be returned for any reason within 30 days of delivery, subject to the conditions below:
Return Conditions
- You are responsible for return shipping costs. Original shipping/handling is nonrefundable.
- Packages returned without tracking may not be refunded if lost.
- Email hello@flowermoxie.com before returning and provide tracking details once shipped.
- Do not return damaged items — contact us and we’ll replace damaged items with proper documentation.
- Items must be unused, in brand-new condition, and returned in original packaging, packed securely to avoid damage.
- Returns must be shipped within 30 days of delivery.
- Refunds are issued to the original payment method.
- Failure to follow these conditions may result in a reduced refund.
- Please allow up to 5 business days after your return is received for processing.
13) Promotions & Discount Codes
- One discount code per order unless otherwise stated.
- Promotions cannot typically be applied retroactively.
- We may modify or end promotions at any time.
14) Refusal of Service
We reserve the right to refuse or cancel service at our discretion.
Customers who are rude, abusive, harassing, excessively demanding, or use hate speech may have their order canceled. Refunds, if issued, apply only to unshipped/unfulfilled items.
15) Intellectual Property
All content on the Site—including text, images, videos, designs, guides, downloads, logos, and the overall look and feel—is owned by Flower Moxie or its licensors and protected by intellectual property laws.
You may not copy, reproduce, distribute, publish, publicly display, create derivative works from, or commercially exploit our content without prior written consent.

16) User Content (Reviews, Photos, Tags You Share)
If you submit content (reviews, photos, videos, comments, DMs, etc.), you grant Flower Moxie a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content for marketing and promotional purposes, unless you request otherwise in writing. You represent that you have the rights to share it.
17) Prohibited Use
You agree not to:
- misuse the Site (scraping, hacking, introducing malware),
- violate laws,
- infringe intellectual property,
- harass or threaten others,
- interfere with Site functionality or security.
18) Disclaimers
The Site, Products, Services, and Content are provided “as is” and “as available.” We do not guarantee uninterrupted access to the Site or that content will be error-free.
Fresh flowers are perishable and naturally variable. We do not guarantee exact color matching, bloom stage on arrival, or identical appearance to photos.
Some jurisdictions provide consumer rights that cannot be waived; these Terms apply to the maximum extent permitted by law.
19) Limitation of Liability
To the fullest extent permitted by law:
- Flower Moxie is not liable for indirect, incidental, special, consequential, or punitive damages (including event costs or replacement costs).
- Total liability for any claim will not exceed the amount you paid for the specific product(s) giving rise to the claim.
- We are not responsible for carrier failures or delays once a package is tendered to the carrier.
20) Indemnification
You agree to indemnify and hold harmless Flower Moxie and its employees, contractors, and affiliates from claims arising out of your misuse of the Site, violation of these Terms, or infringement of third-party rights.
21) Governing Law & Venue
These Terms are governed by the laws of the State of Oklahoma, without regard to conflict-of-law principles. Any disputes shall be brought in state or federal courts located in Oklahoma County, Oklahoma.
Before filing a formal dispute, you agree to contact us at hello@flowermoxie.com (or the appropriate support email above) and allow a good-faith attempt to resolve the issue.
22) Severability & Entire Agreement
If any provision is found unenforceable, the remaining provisions remain in effect. These Terms (and any policies linked on the Site) constitute the entire agreement between you and Flower Moxie regarding Site use and purchases.
